Twists ‘n Turns of the Law

Essays on Selected Topics in Indian jurisprudence

by Kunal Basu

2019568 pages

About the book

This book of twenty four essays presents selected topics in Indian jurisprudence in diverse fields, inter alia , of constitutional, criminal, commercial, environmental, Islamic and land law. International law on anti-money laundering and the global debate on the death penalty are major highlights that juxtapose Indian law with international laws and practice. For readers’ convenience, the essays have been grouped in eight distinct themes. Women feature prominently in a chapter dedicated to gender jurisprudence. The author includes an interesting feature on psychology in law and traces the development of fingerprinting and fair trial in India and overseas. It also delves into two contentious contemporary issues, viz. adultery and defamation. This is the author’s second book and he is hopeful of publishing more in the near future.

Contents

  • The law, Lady Frances, is an uncertain animal. It has twists and turns that surprise the non-legal mind.
  • ― Dame Agatha Christie, Why Didn't They Ask Evans?
  • There are many pleasant fictions of the law in constant operation, but there is not one so pleasant or practically humorous as that which supposes every man to be of equal value in its impartial eye, and the benefits of all laws to be equally attainable by all men, without the smallest reference to the furniture of their pockets.
  • - Charles Dickens, Nicholas Nickleby
  • If the law supposes that," said Mr. Bumble, squeezing his hat emphatically in both hands, "the law is an ass — an idiot. If that's the eye of the law, the law is a bachelor; and the worst I wish the law is that his eye may be opened by experience— by experience.”
  • ― Charles Dickens, Oliver Twist
